Stockman moves to automatically kill unconstitutional Senate Amnesty Bill
WASHINGTON -- Congressman Steve Stockman Thursday sent a letter to
House Speaker John Boehner requesting he immediately kill the Senate’s
amnesty bill, S. 774 through a constitutionally-required “blue slip”
resolution.
“Not only is the Senate amnesty bill an abuse of taxpayers and immigrants, it’s utterly unconstitutional. The Senate cannot invent its own amnesty taxes,” said Stockman. “I hope Speaker Boehner will immediately kill the amnesty bill through a constitutionally-required blue slip. As long as the amnesty bill sits in the House it poses a threat to taxpayers and immigrants.”
Several provisions of the Senate amnesty bill create new taxes, a violation of the “origination clause,” Article I, Section 7, Clause 1 of the United States Constitution, which states “All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.”
A “blue slip” is a resolution that automatically returns to the Senate any bill that violates the origination clause of the United States Constitution.
Blue slip resolutions are immediately considered as a matter of constitutional privilege, are debatable for an hour and are not subject to amendment.
Section 2102 of the amnesty bill requires the payment of certain taxes and forgives the payment of other taxes as a condition of receiving amnesty and other benefits. The Constitution prohibits the Senate from approving bills that raise revenue.
Stockman also points to the Congressional Budget Office, which flatly states “enacting S. 744 would have a wide range of effects on federal revenues, including changes in collections of income and payroll taxes, certain visa fees that are classified as revenues, and various fines and penalties. Taken together, those effects would increase revenues by $459 billion over the 2014-2023 period.”
Stockman’s letter to Boehner follows.

Honorable John Boehner
Speaker of the House of Representatives
Washington, D.C. 20515
Dear Mr. Speaker,
When the House of Representatives receives S. 744, I hereby request that you raise a point of order that the legislation violates the origination clause of the United States Constitution; that “all Bills for raising Revenue shall originate in the House of Representatives.”
Although there are other provisions in the bill which are in violation of the prerogatives of the House, the most obvious is section 2102 which requires the payment of certain taxes and forgives the payment of other taxes as a condition of receiving benefits under this legislation.
The Congressional Budget Office analysis of S. 744, dated June 18, 2013, on page 44 states in part that “enacting S. 744 would have a wide range of effects on federal revenues, including changes in collections of income and payroll taxes, certain visa fees that are classified as revenues, and various fines and penalties. Taken together, those effects would increase revenues by $459 billion over the 2014-2023 period, according to estimates by JCT and CBO.”
Therefore, I urge you to protect the origination clause and the intent of the Constitution by using the ‘blue slip’ to return S. 744 to the Senate.
I am grateful for your service to our nation in upholding the Constitution.
Warmest Regards,
Steve Stockman

Congressman Steve Stockman's AR-15 winner
Dear Patriot,
I’d like to express my heartfelt thanks to the nearly 100,000 participants in a special sweepstakes for an AR-15.
The winning number was drawn on Independence Day in Lumberton, Texas.
The lucky winner has been notified, and pending verification will be presented with the firearm in the coming
days.
If the Minute Men were around today, I believe they would be carrying a rifle resembling the AR-15.
I refer to such firearms as the torch, or symbol, of freedom.
In Washington, where I am honored to serve as a representative in Congress, anti-gunners are clamoring to restrict your right
to keep and bear arms.
They forget that their “just powers” are derived from the “consent of the governed.”
That’s why it’s so important for you, the voter, to stay active in the political battles.
And that’s the real reason I gave away an AR-15 rifle.
I want as many people as possible to be involved in the political process, to be aware of what’s happening to our
liberty.
If it takes giving away a rifle to get more people in involved, then I’ll do it.
Protecting our constitutional rights is what is needed more than ever.
America is great because of the foundation laid more than 230 years ago.
If that foundation is destroyed, America will cease to be great.
It’s as simple as that.
I hope that you agree, and that you will stand with me in this fight for the Constitution and the Second
Amendment.
If you can provide financial support, thank you so much.
Gun grabbers would happy if I were defeated, so I rely on individuals like you for support.
But I also know these are tough economic times for many. So even if you
can’t afford to give right now, please stay active.
I send out frequent updates on legislation, which you can forward to your friends and get even more people active in
politics.
Below is a video of the drawing. Please stay tuned for our next offer, which will
be announced soon!
Warm Regards,
Congressman Steve Stockman
P.S. The drawing of the Ar-15 is over, and it was a tremendous success. Thanks
again to all participants.

The facts on late term abortion, a shocking death toll
According to Planned Parenthood's Guttmacher Institute 4.8% of all abortions are performed
after 17 weeks. At around 1.2 million abortions each year in the US
that's around 60,000 abortions performed late into pregnancy.
Based on 2010 numbers from the CDC, that's more deaths from late term abortions than from influenza each year, and on par with the annual death toll from diabetes. Late term abortions kill almost twice as many people each year than do suicides.
Pro-abortion lobbyists say there are "virtually no" abortions performed that late, but the number of people killed each year by late term abortions is more than the Astrodome can seat.
That's how many babies are shredded alive every year late into pregnancy.

My statement to The Daily Show
As the Undisputed 2013 SNAP Challenge Champion, I beat the Challenge hands down. SNAP cards are filled monthly. I spent $34.28 for nine days' stock of food. That's $3.81 a day. And I have food left over.
The exercise proves we can cut SNAP benefits by 15%.
As for the the flight, I found out Tuesday I'd be traveling Thursday. Had I spent the $50 to check a bag and bring the last two days of the seven days of food liberals would be whining about that. The fact I went an additional two days with my shopping proves you can stay below the $4.50 figure even when you go longer and run into unexpected travel.
I proved there is double digits worth of room to cut in welfare spending, and that's what has liberals whining.

‘Undisputed 2013 SNAP Challenge Champion’ debunks liberal propaganda
‘SNAP Challenge’ shows plenty of room to cut unsustainable levels of spending
‘Nothing tastes better than debunking liberalism.’
‘If liberals don’t like the results they shouldn’t have issued
the challenge.’
WASHINGTON -- After going a full week on less than the $4.50
a day in food laid out by the “SNAP Challenge,” Donny Ferguson, communications
director and agriculture policy advisor to Rep. Steve Stockman (R-TX 36,) is
declaring himself “The Undisputed 2013 SNAP Challenge Champion.”
“Nothing tastes better than debunking liberalism. I proved there’s still lots of room to cut unsustainable
welfare spending and still have filling, delicious meals. The SNAP Challenge is a great tool to show
how much savings we can find in the budget,” said Ferguson. “The only thing Democrats proved is they can’t
budget or control spending. Their only
defense is to trash the SNAP Challenge as an unrealistic publicity stunt.”
“If liberals don’t like the results they shouldn’t have
issued the challenge. I’m not aware of who
else successfully completed all seven days, and I doubt any of them fed
themselves as fiscally responsibly as I did,” said Ferguson. “I’ve been broke much of my life so it’s not
much of a lifestyle change.”
“If liberals cared about the poor they’d stop their agenda
of tax hikes and regulations that kill jobs and make food more expensive. If liberals really cared they’d stop creating
punishing inflation by supporting Audit The Fed and other measures to stop the
Federal Reserve’s reckless inflationary policies,” said Ferguson.
Without a shopping list or coupons, over the week Ferguson
fed himself filling meals for seven days for a final total of around $26.40,
less than the $31.50 weekly budget issued by the SNAP Challenge and less than
his original $27.58 budget. He gained
only one pound and lost one percent body fat.
“I cut the SNAP Challenge Budget by about 16 percent without
the hysterics of overdramatic political activists agitating for more government
control,” said Ferguson. “The proposed
Food Stamp Bill didn’t cut spending, it dramatically increases it. Overall spending on food stamps would have
skyrocketed well beyond the increased rates of suffering we’ve seen under Obama.”
“Liberals are using unsustainable levels of welfare spending
as vote-buying programs. They terrorize the poor and vulnerable with
fictionalized tales of disaster if they don’t deliver their votes,” said
Ferguson. “It’s abusive to the poor,
it’s abusive to the taxpayer, it’s abusive to our system of free elections and
it’s put us on a path to fiscal suicide.”
For the first five days of the Challenge Ferguson stuck to a
daily diet budget of $3.94 a day. That’s
a 12 percent cut to the Challenge’s claimed $4.50 a day in Supplemental
Nutrition Assistance Program benefits.
Unplanned travel took Ferguson out of town for the last two
days. There, Ferguson purchased two days
worth of food, including meat and fresh fruit, for $6.70, less than the $9.00
allowed over two days. He spent the
remainder of the SNAP Challenge two-day budget on canned food donated to a
local food bank.
For $6.70 Ferguson bought two apples, two bananas, two large
bowls of noodles, two bowls of pre-cooked rice and three cans of pre-cooked
meat.
All remaining untouched food will be donated to a D.C. area
food bank.

ATF agent says Obama admin ordered him to allow guns to Mexican drug lords
A senior ATF agent is openly contradicting President Barack Obama, telling CBS News the Obama administration expressly ordered him to allow Mexican drug lords to access weapons, including the guns that killed Agent Brian Terry.
"An Alcohol, Tobacco and Firearms senior agent assigned to the Phoenix office in 2010, (John) Dodson's job is to stop gun trafficking across the border. Instead, he says he was ordered to sit by and watch it happen," CBS News reports. "Agent Dodson and other sources say the gun walking strategy was approved all the way up to the Justice Department."
CBS also has video showing suspected drug cartel suppliers arming themselves with AK-47s. The video was recorded by ATF, but the Obama administration ordered agents not to arrest criminals.
Agent Dodson tells CBS thousands of weapons supplied to Mexican drug lords by Obama are still in the hands of violent killers, which will continue to add the current number of over 300 murders with weapons supplied by Obama.

Congress takes aim at government ammo hoarding
WASHINGTON - U.S. Sen. Jim Inhofe (R-Okla.) and Congressman Frank
Lucas (R-OK-3) introduced in their respective chambers Apr. 29 the
Ammunition Management for More Obtainability (AMMO) Act of 2013. The
legislation would require the Government Accountability Office (GAO) to
conduct a report on the purchasing of ammunition by federal agencies,
except the Department of Defense, and its effect on the supply of
ammunition available to the public. The AMMO Act would restrict agencies
from obtaining additional ammunition for a six-month period if current
agency stockpiles are higher than its monthly averages prior to the
Obama Administration.
"President Obama has been adamant about curbing law-abiding Americans’ access and opportunities to exercise their Second Amendment rights," said Inhofe.
"One way the Obama Administration is able to do this is by limiting what’s available in the market with federal agencies purchasing unnecessary stockpiles of ammunition. As the public learned in a House committee hearing this week, the Department of Homeland Security has two years worth of ammo on hand and allots nearly 1,000 more rounds of ammunition for DHS officers than is used on average by our Army officers.
"The AMMO Act of 2013 will enforce transparency and accountability of federal agencies’ ammunition supply while also protecting law-abiding citizens access to these resources.”
“After hearing from my constituents about the shortage of ammunition in Oklahoma and the Department of Homeland Security’s profligate purchases of ammunition,” said Lucas.
“We have introduced the AMMO Act of 2013 to curtail these purchases so Americans can exercise their Second Amendment rights without being encumbered by the federal government.
"I was surprised to find out the DHS has the right to buy up to 750 million rounds of ammunition over the next five years, while it already has two years worth of ammo already. This is an issue that must be addressed, and I am pleased this legislation provides us the opportunity to do so.”

Congress demands answers on Common Core
WASHINGTON – Steadfastly opposed to federal bureaucrats rewriting
education and student privacy policies without congressional approval,
Rep. Steve Stockman (R-Txas 36) signed on to a letter authored by Rep.
Blaine Luetkemeyer (R-MO 3) to Education Secretary Arne Duncan demanding
information regarding the implementation of these new policies and the
authority under which the Education Department has acted.
Dating back to the 1960s, Congress has authorized and allocated funding for K-12 education policy through the Elementary and Secondary Education Act (ESEA) – the primary vehicle for education reform on the federal level. The letter notes since ESEA’s most recent expiration the Education Department has, without any Congressional input, moved forward with Common Core standards by enticing states with grants and waivers to adopt Common Core standards.
“Since the ESEA’s expiration, the Department of Education has moved forward with education policy reform without Congressional input. Such action is, at best, in contravention with precedent,” read the letter signed by Stockman and 33 other members of the House of Representative. “We believe that state-based education policies are vital to the successful education of a child. As with most one-size-fits-all policies, Common Core standards fail to address the specific needs of our states.”
The letter also addresses two changes in which the government collects and distributes student data. Members of Congress request a detailed description of each change to student privacy policy that has been made during Duncan’s tenure and the need and intended purpose for such changes. Of particular concern were regulatory changes made without congressional review regarding parental access to student education records and limiting third party disclosure of that information.
“We also request that you submit to us the authority under which the Department has implemented Common Core and altered polices on student policy…” the letter asks.
Below is the text of the House letter to Duncan:
The Honorable Arne Duncan
Secretary
U.S. Department of Education
400 Maryland Avenue, SW
Washington, D.C. 20202
Dear Secretary Duncan,
As you know, the Elementary and Secondary Education Act (ESEA) allows Congress to authorize and allocate funding for public K-12 education and, most importantly, is the primary vehicle in which we implement education policy reform. Most recently reauthorized through the No Child Left Behind Act of 2001 (NCLB), the ESEA’s authorization expired on September 30, 2008, and has yet to be reauthorized. Since the ESEA’s expiration, the Department of Education (Department) has moved forward with education policy reform without Congressional input. Such action is, at best, in contravention with precedent.
In addition to expressing our concern with the Department’s circumvention of Congress to reform education policy, we are writing you to express our concerns with the implementation of Common Core standards and changes to federal data collection and disbursement policies.
In 2009, forty-six governors signed a memorandum of understanding with the National Governor’s Association committing their states to the development and adoption of new education standards within three years. As we understand it, states then had the option of adopting Common Core standards or creating their own equivalent standards. At the time, Common Core standards were simply an idea where states would collaborate to create uniformed education standards. Details about Common Core were not only unknown to the states, they did not exist. From there, the Department offered Race To The Top (RTTT) grants and NCLB waivers to states under the condition that each state would implement “college and career ready” standards. At the time, the only “college and career ready” standards with the Department’s approval were Common Core.
In addition to serious concerns we have regarding the Department’s aforementioned coercion of states to opt-in to Common Core standards, many of which were and continue to have serious budgetary issues and specific issues with existing education policies, we have become increasingly concerned over the development of the Common Core standards themselves. Though initially promoted as state-based education standards, Common Core standards, as they have been developed over the last few years, are nothing of the sort. In just one very troubling instance, Common Core standards will replace state-based standardized testing with nationally-based standardized testing, the creation and initial implementation of which will be funded in full by the federal government. The long-term, annual administering of the exams, the cost of which has not been specified by the Department, is to be funded by the states.
As representatives from states across the nation, we understand the diverse cultures and state-specific education needs that exist in America. We believe that state-driven education policy is vital to the success of our children and that Members of Congress can best demonstrate the specific needs of their constituents. As with most one-size-fits-all policies, Common Core standards fail to address these needs.
As you know, because states opted-in to Common Core standards, there is little Congress can do to provide any relief from these burdensome and misguided standards. Instead, the ability to opt-out of these standards lies with the state. With that in mind, we will be working with our respective state legislatures and governors to provide relief to our education systems. In the meantime, we urge you to work with Members of Congress to reauthorize the ESEA in a manner that allows state-specific education needs to be addressed.
Separate from reauthorization, we are extremely concerned over recent changes the Department has made to the manner in which the federal government collects and distributes student data.
As you know, the Family Educational Rights and Privacy Act (FERPA) was signed into law in 1974, guaranteeing parental access to student education records and limiting their disclosure to third parties. FERPA was intended to address parents’ growing privacy concerns and grant parental access to the information schools use to make decisions that impact their children.
Once again circumventing Congress, in 2011 the Department took regulatory action to alter definitions within FERPA. With the technological advances that have occurred in recent years, changes to FERPA deserve the full scrutiny of the legislative process more so than ever before.
In addition, we understand that as a condition of applying for RTTT grant funding, states obligated themselves to implement a State Longitudinal Database System (SLDS) used to track students by obtaining personally identifiable information.
Regarding these two very concerning changes to the manner in which government collects and distributes student data, we formally request a detailed description of each change to student privacy policy that has been made under your leadership, including the need and intended purpose for such changes.
In addition, we request that you submit to us the authority under which the Department has implemented Common Core and altered polices on student policy, specifically relating to FERPA and SLDS.
It is our sincere hope that the Department works with the Legislative Branch to implement any changes to education standards and student privacy policy. We look forward to your response and welcome the opportunity to address these issues in the future.

Uh-“O”!: May’s Obama Failometer score is an off-the-charts 1,166
WASHINGTON – The nation’s economy is worse off under Obama than under
Bush for yet another month, according to an objective mathematical
measurement of the nation’s economic indicators released Friday by
Congressman Steve Stockman (R-Texas 36.)
May’s Obama Failometer Score is an astonishing 1,166, indicating widespread economic suffering, especially among blacks and Hispanics.
“Not only is Obama choking the life out of the economy, Obama is punishing blacks and Hispanics the harshest. No wonder Obama has completely given up on the economy and is now focused on radical left-wing wedge issues,” said Stockman.
The Obama Failometer uses a fixed mathematical score to calculate four economic indicators from the Bureau of Labor Statistics. The figures from the monthly reports are weighted to provide a balanced total score, which ranges from zero to 1,000. A score of 0 represent economic stability and racial equality. The higher the score, the deeper the economic failure.
Obama can set the Failometer to zero simply by outperforming Bush on the economy and fulfilling his 2008 and 2012 campaign promises to help blacks and Hispanics gain economically.
So far, Obama is worse than Bush.
Since its creation Obama has failed to generate a Failometer score that can be contained within the chart’s range of zero to 1000.
The Obama Failometer Score was originally displayed on a ten-foot-long billboard displayed in the hallways of the Capitol’s Cannon House Office building. House officials ordered it torn down in January after Democrats complained.
Here is how the Obama Failometer Score is calculated:
FACTORS MEASURED AGAINST BUSH
Monthly jobs created: The Hamilton Project, a liberal economic policy group, states the economy must create 321,000 jobs a month in order to return the economy to pre-recession employment levels by December 2016, the end of Obama’s term.
Obama promised to not only restore the economy to where it was under Bush, but grow it. So far Obama has failed to even perform as well as Bush.
This Obama Failometer score portion is calculated by subtracting the number of jobs created in the previous month from the 321,000 jobs claimed necessary by the liberal Hamilton Project and dividing by 1,000 to balance it against other factors.
The BLS reports the economy created 165,000 jobs in April, 156,000 fewer than needed to restore the economy. This portion of the Obama Failometer Score is 156.
Civilian labor force participation rate: The civilian labor force participation rate, the ratio between those 16 and over in the labor force against the national population of those 16 and over, is an important measure of economic health. After puttering along during the Bush administration, including through the “Bush years” of the recession, under Obama it has plunged sharply.
This Obama Failometer score portion is calculated by subtracting the monthly civilian labor force participation rate from the average Bush administration rate and multiplying by 100 to balance it against other factors. According to data from the BLS, under Bush the average monthly civilian labor force participation rate was around 66.2 percent.
The Bureau of Labor Statistics reports the monthly civilian labor force participation rate for April is stagnant at an abysmal 63.3 percent, close to the record low and a gap against Bush of 2.9 percent. This portion of the Obama Failometer Score is 290.
FACTORS MEASURED AGAINST OBAMA’S OWN RHETORIC
Black unemployment: No one has suffered more economically under Obama than black Americans. Obama’s election and re-election has meant crippling poverty for the black community.
This Obama Failometer score portion is calculated by taking the monthly unemployment rate for blacks and subtracting the monthly unemployment rate for all Americans, and multiplying it by 100 to balance it against other factors.
The Bureau of Labor Statistics reports the black unemployment rate for April was a depressing 13.2 percent, while the national overall rate was 7.7 percent. That is a gap of 5.7 percent, the same last month. This portion of the Obama Failometer Score is 570.
Compare Obama’s performance to Bush’s. The highest monthly unemployment rate ever for blacks under Bush was 12.1 percent. Obama’s lowest rate was 12.7 percent in January, a figure he largely inherited. He has never performed as well as Bush’s worst black unemployment rate.
Bush’s average black unemployment rate was 9.7 percent and an overall national average of 5.2 percent, a 4.5 percent gap that gives Bush a score of 450.
Hispanic unemployment: Despite winning the Hispanic vote, Obama’s liberal policies have caused widespread damage to the Hispanic community. Thanks to Obama, they continue to lag behind the national average in many economic factors.
This Obama Failometer score portion is calculated by taking the monthly unemployment rate for Hispanics and subtracting the monthly unemployment rate for all Americans, and multiplying it by 100 to balance it against other factors.
The Bureau of Labor Statistics reports the Hispanic unemployment rate for March was a pitiful 9.0 percent, while the national overall rate was 7.5 percent. That is a gap of 1.5 percent. This portion of the Obama Failometer Score is 150.
The Hispanic unemployment rate hit its all-time historic low of 4.7 percent during Bush's last term. It is almost twice that rate under Obama.
THEREFORE, APRIL’S OBAMA FAILOMETER SCORE IS 1166.

GOP says April jobs report shows more work to be done
WASHINGTON - Republican Study Committee Chairman Steve Scalise Friday issued the
following statement after the U.S. Bureau of Labor Statistics released
the April jobs report.
“On the heels of March’s lowest workforce participation in more than 30 years, today’s April jobs report shows there’s still much work to be done,” Scalise said. “According to recent reports, private sector job growth, the backbone of our economy, slowed to a crawl in April as companies hired fewer employees than they had each of the last seven months. Contrary to the popular belief among Washington liberals, a bigger federal government is the problem not the solution.
“There are common-sense solutions to address America's economic problems that House Republicans continue fighting for, like green lighting the Keystone XL Pipeline that will create 20,000 jobs and promote a healthy economy here at home. Next week, the House will take another proactive step to protect America’s credit rating and safeguard our economy by passing the Full Faith and Credit Act. It’s time for liberals in Washington to stop focusing on raising taxes and threatening default, and start working with us responsibly to finally balance the federal budget.”

Obama's new gun-grabbing Executive Order
“Gun
Owners of America [has] spent the months since Newtown doing tremendous
damage, insisting that expanded background checks will lead to a gun
registry.” - New York Times, April 4, 2013
It’s quite a complement when the New York Times thinks that you are doing “tremendous damage.”
But you can be sure that the other side is not going to go away quietly.
And sure enough, the Obama Administration is trying to unilaterally undo our recent victory in the Senate - and to undo the “damage” that all of us inflicted together.
But first, a little history.
Remember when Senators Pat Toomey, Joe Manchin and Chuck Schumer formed an unholy alliance during the recent gun battle on Capitol Hill? Remember how their amendment would have encouraged your psychiatrist to turn you in to the FBI's gun ban list?
And you remember how we stopped that provision, because over 40 senators found it to be odious and a violation of the Second Amendment?
Well, guess what? Barack Obama has just concluded that "he don't need no stinkin’ Senate."
Instead, Secretary Kathleen "ObamaCare" Sebelius - and her Department of Health and Human Services - has promulgated regulations which would, by executive fiat, waive all federal privacy laws and encourage you doctor to report you to the FBI.
Understand a couple of things: First, the standard which your doctor would use to turn you in is embodied in Clinton-era ATF language and in the anti-gun Veterans Disarmament Act of 2007.
Specifically, you doctor would "drop a dime" on you if he suspected you were even a slight "danger to yourself of others" or were "unable to manage your financial affairs."
So if they say you can't balance your checkbook, then you lose your constitutional rights.
But there's another problem: The day these regulations become law, lawyers will be lining up to sue "deep-pocket" psychiatrists for every case where they failed to turn in a patient to NICS - if the patient subsequently engages in a horrific act.
The bottom line? Any psychiatrist who failed to report all of his patients to the NICS system risks losing everything if any of them engages in harmful conduct. Soon the rule of thumb will be: See a shrink; lose your guns.
And the regulations will apply to private, as well as government-employed psychiatrists.
The bad news is that 165,000 military veterans have already lost their gun rights because of the “see a VA shrink, lose your gun rights” precedent from the Clinton-Bush era.
Sadly, what happened to military veterans has now begun in the private sector - especially in places like New York, after they recently passed their misnamed SAFE Act.
According to gun rights reporter, Dan Roberts, firearms are now being confiscated from gun owners because of their mental health information. For example:
“[John Doe] received a letter from the Pistol Permit Department informing him that his license was immediately revoked upon information that he was seeing a therapist for anxiety and had been prescribed an anxiety drug. He was never suicidal, never violent, and has no criminal history.”
So now taking anxiety pills can result in one’s forfeiting their Second Amendment rights in New York!
This is where the gun haters want to push their agenda. And this is one reason why background checks are so dangerous - because they give government bureaucrats the opportunity to deny law-abiding people their constitutionally-protected rights.
But the good news is this: The HHS rulemaking is still at an early stage, and HHS is (no doubt reluctantly) taking the views of the general public.
ACTION: Go to the Federal Register - at http://www.gpo.gov/fdsys/pkg/FR-2013-04-23/pdf/2013-09602.pdf - and respond to the regs entitled “HIPAA Privacy Rule and the National Instant Criminal Background Check System (NICS).”
Let the HHS know how you feel about waiving all federal privacy laws for people who seek
counseling.
Also, be sure to tell your congressmen that you oppose the “see a shrink, lose your guns” regs issued by the HHS. Ask him to issue his own comments as well.
The regs themselves lay out several ways that you may submit your opposition. The comment period ends on June 7, 2013.

No NASA Cuts: Stockman urges Obama to adopt Smartquester
WASHINGTON – Congressman Steve Stockman Thursday once again urged Obama
to drop his plans for across-the-board sequestration cuts and instead
adopt the “Stockman Smartquester.
“Obama is threatening to move ahead with his sequestration cuts if Republicans don’t give in to his demands for higher taxes,” said Stockman. “Republicans already gave Obama tax hikes without spending cuts. Obama needs to stop bullying people, drop his own sequester and reduce spending with smart cuts.”
“I’m working to avoid needless cuts to critical programs like NASA and permitting for oil, gas and timber,” said Stockman. “Obama wants to use his sequester to spread fear and panic.”
While Obama’s sequester seeks $83.4 billion in spending cuts, the Stockman Smartquester saves even more money, $84 billion from just five programs, without touching essential services.
“Not only does the Stockman Smartquester save even more money than Obama’s blunt sequester cuts, it cuts spending without touching critical programs like police, schools and NASA,” said Stockman.
The plan, five simple spending cuts which meet Obama’s sequester reduction targets without cuts to essential programs, is outlined below:
Eliminate the government’s “free cell phone” plan that has ballooned into the ObamaPhone giveaway, 41 percent of which goes to people not even eligible:
$2.2 billion in savings
Eliminate ObamaCare’s “Public Health Slush Fund,” which even Democrats want to eliminate:
$10 billion in savings
Require food stamp recipients, the numbers of which have exploded under Obama, to actually be eligible for food stamps:
$26 billion in savings
Eliminate overpayments for ObamaCare exchange subsidies:
$44 billion in savings
Eliminate Obama’s “renewable energy” fund in the Energy Department
$1.8 billion in savings
TOTAL SAVINGS
$84 billion

Stockman requests White House records after weak, suspicious response to Obama anti-gun campaign
WASHINGTON – Congressman Steve Stockman (R-Texas 36) Tuesday sent
certified letters to The White House and Organizing for America
requesting all documentation on President Barack Obama’s anti-gun
campaign to determine what, if any, fraudulent or deceptive tactics are
being used.
The request comes after Obama issued a national call for Americans to contact their member of Congress using Twitter to demand anti-gun laws. Despite the national call by Obama himself, only 16 members of Congress were contacted. Stockman received only 16 messages, ten of which resemble “spam” messages from computer-generated accounts. Only one could be verified as coming from an actual constituent.
“Not only was the response to President Obama’s anti-gun call for action embarrassingly pathetic, it appears to be generated mostly by spammers. Congress deserves to know what, if any, fraudulent or deceptive tactics to influence policy were carried out with White House knowledge. We hope the President will live up to his word on transparency and tell the truth about his deceptive anti-gun campaign,” said Stockman.
“For the President himself to issue a call to action and only get 16 responses, only one of which can be verified as an actual constituent, is a massive failure. Not only is he doing as bad job as President, he can’t even do a good job community organizing,” said Stockman “We get hundreds of real emails, phone calls and letters every day from real constituents who have composed their own messages supporting the civil right to keep and bear arms. I deeply appreciate everyone who takes the time to contact me regardless of their opinion.”
“The President exudes weakness. The incumbent President spent $1 billion dollars on his re-election campaign and managed just 51 percent of the vote. Under Obama Democrats have lost four Senate seats and 55 House seats. It’s no surprise he got only 16 responses to a national call to action,” said Stockman. “He is leading his party into oblivion.”
“I’m signed up on Obama’s email through three different accounts to three different names. Had I responded to that email I could have posed as three different people,” said Senior Communications Adviser Donny Ferguson. “People use the telephone and postcards when they want to communicate with Congress. People use Twitter to troll, scam and sell fake real estate. The choice by Obama to use Twitter instead of methods that can be verified screams desperation and deception.”
The letters, which are attached, were sent to White House Chief of Staff Denis McDonough and Organizing for Action Executive Director Jon Carson.

Stockman slams Obama’s ‘scarequester’ scheme to release criminals
WASHINGTON -- Congressman Steve Stockman (R-Texas 36) demanded the
White House stop releasing illegal aliens from federal custody as part
of an administration effort to build public fear of Obama’s own
sequestration plan and give him leverage to demand tax hikes.
“Obama is releasing illegals into the streets before his sequester in hopes of using fear as negotiating tactic for higher taxes. He’s literally placing American lives in danger for partisan gain,” said Stockman.
“Rather than cut spending for the free ObamaPhone giveaway Obama is releasing criminals from federal custody. He proposed sequester, demanded it as a condition of a debt increase and signed it into law. He’s using his sequester to needlessly threaten public safety if he doesn’t get his tax hikes,” said Stockman.
“It’s childish, reckless and beneath the dignity of the office,” said Stockman. “Even Bob Woodward accuses Obama of ‘madness.’”
Arizona officials tell Fox News that Immigrations and Customs enforcement officials plan to release 10,000 illegal aliens from federal custody to meet the terms of Obama’s sequester.
House Republicans have passed two bills to replace Obama’s sequester with targeted spending cuts. Obama refuses to negotiate and is now demanding tax hikes in exchange for an agreement to end his sequester.

Congressman Stockman's Weekly Column
You’ll be hearing a lot about “sequester” this week.
And you deserve to know the truth, how it will affect Southeast Texas and how my proposed alternative, the Stockman Smartquester, reduces more spending than Obama’s sequester without touching vital services.
Under an agreement proposed and demanded by President Obama to raise the debt ceiling in 2011, unless the White House and Congress agree on a plan to reduce federal spending by March 1, 2013, a series of small across-the-board spending cuts will take place. These broad, very shallow, cuts amount to $83.4 billion, which is just two percent of the total current budget. Even with sequester federal spending will be higher than it ever was under President Bush.
The plan was proposed by President Obama. He demanded it be part of the deal to temporarily increase the debt ceiling. He signed it into law. He once vowed he would veto Republican efforts to replace it with spending cuts targeted at waste.
And now, like Dr. Frankenstein, he’s running from his own creation, claiming a two percent cut will create “devastation” and demanding Congress agree to his terms before he’ll agree to any changes to federal spending. He is using his March 1 deadline like a time bomb.
It’s how Obama has governed since he took office. He constructs bad policy, gives it a deadline and refuses to negotiate or compromise. When the deadline is near, then he claims his opponents are pushing the country into a crisis and they must agree to his terms to stop the
crisis (which he created.) He is helped every step of the way by a compliant national media.
Not happy with just creating bad policy, Obama is also falsely claiming the tiny cuts will force the government to lay off local police officers and firefighters.
That’s flat-out untrue. Not only are the cuts so tiny they can be taken entirely out of wasteful programs, what gets cut will be decided by Executive Branch officials, of which Obama himself is the Chief Executive. He can tell officials what to cut to meet his own sequester terms.
Former White House adviser Peggy Noonan calls it "government-by-freakout." It’s irresponsible and childish from a White House that once accused Republicans of “hostage taking.” And it
must stop.
Even The Washington Post’s Bob Woodward, a reliably liberal voice who exposed Richard Nixon’s Watergate scandal, is fed up with Obama claiming Republicans proposed sequester and refuse to compromise. In a Sunday column Woodward writes:
“My extensive reporting for my book ‘The Price of Politics’ shows that the automatic spending cuts were initiated by the White House and were the brainchild of [White House Chief of Staff Jack Lew] and White House congressional relations chief Rob Nabors…Obama personally approved of the plan for Lew and Nabors to propose the sequester to Senate Majority Leader Harry Reid (D-Nev.).”
Republicans only agreed to include Obama’s sequester because he made it clear he would not compromise or agree to a deal, allowing the country to “go over the fiscal cliff” and max out its
borrowing unless Congress agreed to automatic spending cuts – with the intention of using the panic that would create to give him leverage in agitating for higher taxes.
Republicans have passed two different bills replacing Obama’s sequester cuts to vital services with cuts to wasteful programs. But Senate Democrats refuse to hold a vote on passing them and are working with Obama to push the nation into sequester so they can exploit the panic.
Woodward calls out Obama for falsely claiming Republicans won’t compromise, and for exploiting the crisis he created for political gain:
“..the final deal reached between Vice President Biden and Senate Minority Leader Mitch McConnell (R-Ky.) in 2011 included an agreement that there would be no tax increases in the sequester in exchange for what the president was insisting on: an agreement that the nation’s
debt ceiling would be increased for 18 months, so Obama would not have to go through another such negotiation in 2012, when he was running for reelection. So when the president asks that a substitute for the sequester include not just spending cuts but also new revenue, he is moving the goal posts.”
Under Obama’s sequester, programs vital to Southeast Texas could bear the brunt of spending cuts, even though there is plenty of waste that should be eliminated instead.
Obama could again seek cuts to NASA, along with denying funds for port security and dredging and holding up federal permits for logging and gas and oil exploration.
The Obama administration has also announced they are willing to shut down Beaumont’s regional airport to meet the spending cuts, rather than take the cuts out of bloated federal payrolls or idle “stimulus” programs.
Obama wants sequester because he can make spending reform traumatic by cutting vital services and first responders, instead of waste and welfare, to make the issue toxic to voters.
Obama also wants sequester so he can focus his cuts on his political opponents, while rewarding his political cronies by shielding them from spending reform.
That’s reckless, irresponsible and no way for an adult to govern.
Instead, I proposed Friday the “Stockman Smartquester” alternative.
The Stockman Smartquester saves even more money, $84 billion from just five programs, without touching essential services. Not only does the Stockman Smartquester save even more money than Obama’s blunt sequester cuts, it cuts spending without touching critical programs
like police, schools and NASA.
First, we eliminate the government’s “free cell phone” plan that has ballooned into the ObamaPhone giveaway, 41 percent of which goes to people not even eligible. That’s $2.2 billion in savings
Then, we eliminate ObamaCare’s “Public Health Slush Fund,” which even Democrats agree needs to be done. That’s $10 billion in savings
Then, we require food stamp recipients, the numbers of which have exploded under Obama, to actually be eligible for food stamps, saving $26 billion.
We also eliminate, and require repayment of, overpayments for ObamaCare exchange subsidies. That’s $44 billion in savings
Finally, we eliminate Obama’s “renewable energy” fund in the Energy Department, notorious for financing failed projects connected to Obama campaign donors. That saves you $1.8 billion.
That’s $84 billion in savings, meeting the terms of Obama’s $83.4 billion in sequester cuts without touching vital services or harming Southeast Texas.
Clearly you don’t need to target police officers and airports to find just two percent to cut. President Obama’s hysterical press conferences are intended to mislead you and create fear.
Will President Obama agree to the Stockman Smartquester? Or will he continue to push bad policies on timelines and use the ensuing panic to engage in destructive and childish theatrics?
It’s time for the President to lead.

Stockman statement on 2-23 Day of Resistance
I whole heartedly endorse the February 23rd “2-23 Day of Resistance” and
urge every gun owner, and everyone concerned about civil rights and
peace, to call their member of Congress and urge him or her to oppose
all anti-gun legislation.
The right of the people to keep and bear arms in an unalienable civil and human right. An armed populace is the reason the United States are the world’s oldest and most stable democracy.
The purpose of the Second Amendment is clear. Every peaceful person should be able to possess arms without restrictions, reporting or permission to serve as an unorganized civilian military force to resist violence, oppression or invasion.
And that is why I have introduced several pieces of legislation to not just fight gun control, but restore the Second Amendment’s full constitutional protections.
The Safe Schools Act would repeal the federal government’s failed, deadly experiment with so-called “gun free school zones.” Since their introduction in 1990, the number of mass shooting on college and school campuses has increased 500%. So-called “gun free school zones” have made our schools more dangerous.
Senator Rand Paul and I are working together to pass the Restore The Constitution Act. This bill would repeal any past, present or future Executive Order that violates the Second Amendment or assumes the legislative power of Congress. It would stop Obama’s anti-gun power grabs before they can even be signed.
I have also introduced the Veterans Second Amendment Protection Act, which would stop the gun grabbers’ plan to strip peaceful veterans of their right to keep and bear arms just because they once sought counseling. Under this bill, no veteran can be denied a gun without going through the courts and under due process of law. Gun grabbers plan to use a broad, vague definition of mental illness to strip millions of mentally healthy people of their gun rights, and they’re specifically targeting veterans.
And that’s just my first few weeks back in Congress. There will be much more.
But I need you standing with me. Please support my efforts to protect – and restore – the Second Amendment.
The statistics are clear. More guns and more gun capacity in the hands of civilians leads to less crime and more peace. Women especially need to be armed, even if the official and repeated position of the Democrat Party now seems to be that woman are mentally incapable of figuring out how to use a gun. I suggest they come to Texas and speak to our intelligent, empowered women.
We can and will win this fight because more and more Americans understand the right to keep and bear arms is a basic human and civil right that makes society more peaceful. But we won’t win the legislative battle unless all of you begin contacting your congressmen and making it clear any vote for any anti-gun legislation will put them out of a job.
God bless each and every gun owner, and God bless Texas.
